James E. Toner, Esq.

James E. Toner, Esq. was born and raised on Long Island. He is a graduate of
Chaminade High School’s class of 1985
. He earned his BBA in Finance at Hofstra
University’s John Zarb School of Business
and his law degree at the Hofstra University,
Maurice Dean School of Law in 1992
. In Law School Mr. Toner served as the Editor and
Chief of the Hofstra Property Law Journal.

Mr. Toner began his trial career during his second year of law school as a certified legal
intern at the Miami-Dade County Public Defender’s Office obtaining his first “not
guilty” verdict on a felony jury trial.
 

After graduation, he continued his career as a criminal defense lawyer at the Nassau County Legal Aid Society. Mr. Toner’s tenure at legal aid honed his skills as a trial lawyer representing and trying numerous of felony
and misdemeanor cases. 

For the last thirty years, Mr. Toner has continued his passion
for criminal law at his present address in Mineola, located directly across the street from
the Nassau County Court where he has successfully tried many cases including
Homicide, Medicaid Fraud, Money Laundering, Sex tracking, White Collar Crime,
Driving While Intoxicated and Narcotics Trafficking. Mr. Toner recently obtained a not
guilty verdict on homicide charges brought by the New York State Attorney General
Office where his client, a nurse, was accused of disregarding a respiratory alarm
resulting in the tragic death of a patient at the A. Holly Patterson Nursing Home. 

Mr. Toner has represented thousands of Criminal clients in the Nassau County and throughout New York Metropolitan Area In the civil arena, Mr. Toner has recovered millions of dollars for accident victims and through his litigation his successful appellate litigation efforts, extended N.Y. Agency law against students who perform volunteer work on behalf of their colleges. In the case of Betina Filsaime v. Ryder Trs., Inc., Mr. Toner recovered millions of dollars for the benefit of his brain damaged client where a Cornell University student while transporting donated lab equipment from Long Island to Cornell in Ithica, New York caused the accident injuring Ms. Filsaime. 

In addition to Auto accidents, Mr. Toner has recovered substantial sums of money for his clients for bullying, theft of wages and overtime, premises liability, construction accidents and fire. Mr. Toner is admitted in the Appellate Division Second Judicial Department and the Federal District Courts for the Southern, Eastern and Northern Districts of New York.
